DMCA Policy
Kyle Sandilands Got Shock is committed to respecting the intellectual property rights of others. We comply with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines the procedures for copyright owners to notify us of alleged copyright infringement, and for users to submit counter-notifications when their content has been removed due to a copyright claim.
We take copyright infringement seriously and will promptly investigate valid claims and take appropriate action, which may include removing or disabling access to infringing material and, in appropriate circumstances, terminating the accounts of repeat infringers.
Filing a DMCA Notice of Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on Kyle Sandilands Got Shock infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail):
- An electronic or physical signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

- Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that any misrepresentations in your notification could lead to liability for damages, including costs and attorney's fees incurred by us or the alleged infringer. Therefore, if you are not sure whether material infringes your copyright, please contact an attorney before submitting a notification.
Filing a DMCA Counter-Notification
If you believe that your content was removed or access to it was disabled by mistake or misidentification, you have the right to submit a counter-notification. Pursuant to Sections 512(g)(2) and (3) of the DMCA, your counter-notification must be a written communication provided to our Copyright Agent that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Kyle Sandilands Got Shock may be found.
- A statement that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notification. If the original complainant does not file an action seeking a court order against you within 10-14 business days, we may restore the removed material or cease disabling access to it.
